  • Festiva Law

Well today I write to you all with great news and bad news.

First the bad news: The fine state of Pennsylvania and PennDOT will not allow me to have the license plate "MONSTIVA" because it is one (1) character too long. angry9:

Then there was good news: It has been unfamiliar of my Festiva's situation on this forum thus far so first I must catch you up too speed.

I got duped, signed the title over for my 98 Blazer only to find out that the guy I got Monstiva from does not have the title. therefor Monstiva is like 100% illegal. The person that does pocess the title has thus far refused to sign it over because they also got duped on a trade.

BUT I found out today that as long as I can get the person that gave me the Monstiva to sign a bill of sale stating that infact I received her in exchange for my blazer, take the notorized bill of sale to the court of common plee's the judge then will have the authority to either award me the title or request trial with the people that actually hold the title. I was told by PennDOT and State Police that the chances of me being awarded the title for the car that I have been putting money into look pretty good. Keep your fingers crossed for me!!!:tongue5:

Sorry, I have to ask. Why would you sign the Blazer title over without having the Festiva title? Also why would you put money into a vehicle without having the title and making sure it's free of liens? I see this too many times on other forums. It sounds like the other party may of committed fraud if he didn't have ownership of the Festiva. Also if it does go to trial and the title holder wins you will have to relinquish the car to them or strike a deal. However, if the original trade satisfie
s the court you will win. How did he "burn" them? If he gave them a vehicle for the Festiva and it didn't perform like they thought it would, it is on them, buyer beware. Good luck!

I was under the impression he did have the title and k signed the title to the blazer cause the jack wagon that got it got pulled over. I got scared it would come back to me so I signed over the next day. They got burnt cause they bought a ford explorer with a bad granny in exchange for the festiva. They refused to sign the title until the granny got fixed.

Well, I would assume they would have to sign over the Festiva title. It's their duty to check out the Explorer when they make the deal. Is that the Granny Special Edition Explorer?

GL. I'm guessing more than a few festiva owners have/had several festivas because of the same situation. It's rust free and runs? It doesn't even rattle on bumps! I can't take this premium example apart! :happy9:

                        Been there, done that. :laughing6:

The only issue in this case is that the original owners are aware. If it was an abandoned vehicle or just "lost & forgotten" it would be less risky.
