  • Bad news for my festy please help!:(

    So I was in accident this morning on the freeway a work truck was going over the speed limit I was in the lane closet to the left side and he was on the left lane I was gonna turn on the lane I checked my blind spots hardly any because Festivas have high visibility when I saw he was behind with me having enough space to merge so I put my signal light and next thing I know I feel a hit on my side , then I pull over and this dude is telling me to give him 300$ for the crash and not contact the police as things will
    Be bad for me as I was at fault according to him, when I was merging he sped way up as I said clearly speeding he didn't do anything to avoid me he just kept going which is why my festy got scraped bad as you will see , here are some pics of the accident who do you think is at fault here ?     I did call the police and they told me to file a report on Monday which I will do then file a claim with his insurance

      You changed lanes. You are at fault. The lane you are changing into must be absolutely clear. Body damage is difficult to repair. Too bad it wasn't a door.

        Thing is I was 90% into the lane I actually had to swerve out because he hit me

          Unfortunate set of circumstances. Brave is correct about the merging vehicle needing to make sure the lane is clear.

          When my son was taking his driving test he was in the right lane on a 4 lane road. The tester told him to merge into the left lane AFTER he made sure it was clear.

          He checked his mirrors and all was clear. He turned on the signal to start the lane change and within that time a car came flying up in the left lane as he was starting the merge.

          Fortunately this was a "ride along" test where a parent rode in the back seat and as I saw what was happening I shouted "NO!" and an accident was avoided.

          My son didn't pass the test THAT day but did the next time as all went well.

          According to your post that is pretty much what happened to you.

          This is why I tried to instill into my kids heads that driving isn't a simple matter of looking out the windshield and pushing the gas pedal. Trying to survey what's around you at all times and use the mirriors frequently as you don't know what may come flying up behind you or beside you.

          Glad you are OK and the bodywork can be handled by any shop who is remotely competent in the "bump and grind" game.


          However, DON'T be surprised if the insurance company attempts to total the vehicle for simple dent removal. It seems the insurance industry deems our cars as disposable (which they rightly are to an extent).


          IF that's the case then I would tell them to pound sand and get it fixed yourself.

            Ya, you're at fault and will be paying for the damage. Pretty sure it is a festy right of passage to have a dinged up rear quarter panel.

              What a shame ! That car looked clean. I hope the guy wasn't just looking for an accident scam. $300 wouldn't touch the damage on either vehicle !?

                Are you flipping kidding me? I was pretty much already on the lane I checked my blind spots! That douche cut me off and made me swerve out like I said he didn't even make an attempt to stop , they're gonna send people to check out the damage on the cars and yea ! Even after I had called the police he kept Insisting on 300$ to keep quiet about the accident

                  And yea if it does come out to be my fault I'm going to get it fixed at a shop, because my insurance dosent have total coverage my parents told me , but really that is bs I'm still counting on my festys body to do the talking with the appraisal people but yea my insurance told me that they would send people to check the damage and stuff

                    I've been in one accident in my life at 16 years old, very similar set up and I was put at fault. Old man came into my lane and I was forced to move over to the third lane and straddled both lanes, the guy in the far outside scraped me on the side. I didn't feel it was my fault or at least not entirely. OH well live and learn I guess.

                      That bs man but good news only gonna cost me 350 to get it fixed at a local shop(:, on the bright side things look up (:

                        The $350 repair sounds really cheap. If you can get it done for that and are happy with the work I would count my blessings.

                        Like I stated earlier, don't be shocked if the adjuster tries to total it. Just giving a fair warning.

                          If he does They can kick rocks. Anyways. He's reputable. I've gotten my mustang fixed there when the whole front was completely destroyed from an intersection crash reason so cheap this time is cause the siZe of car that's why that's what he looks like

                            In my experience it is the car from behinds fault. He has an obligation to avoid an accident that obviously he can only see since he was coming from behind. I am not sure how Texas see's it but it works like that in Ohio.

                              Right of way is determined if you were together in the same lane. Look at it as maintenance of way, like a railway train on the tracks. A streetcar or trolley can't change lanes. So, if it gets hit from the side, guess who's fault it is?

                              The person who hits another directly from behind is always at fault. No control of their vwhicle.

                              I should be a judge.
