Unfortunately, it was still within an hour of the accident, so I would say that would be an acceptable time. But, as you said, the DMV said the ticket will get thrown out, and I'm sure they know what they are talking about. My g/f's car was just in an accident too. They will determine it totaled if the repair costs would be more than 80% of the cars value. If it books for $1000, and there is more than $800 worth of damage, it is totaled. Also, they consider the year too. If the parts are not easily available, they will consider it a total as well. I hope this helps you out a little, and I'm sorry to hear about your baby. I would be really upset if this happened to mine. Hopefully you can either repair it, or at least keep SOME of the parts on the road. Good luck with the court appearance BTW... I'm sure you'll win!

All of this talk of insurance brings up a point to me. Be thankful it didn't happen in MICHIGAN. We have this stupid "no fault" insurance. The maximum you can collect is up to $500 dollars from the person at fault's insurance company. It's a crock of doo-doo.

Yep had that happen to me. Got to keep the car though. Got as much stuff off it as I could. Especially the brand new starter that I had just put in it.

^^ Huh? So if some tard runs a red light and totals your 60K Vette, you can only collect 500 bucks on it?

NO No No! Well yeah I suppose if you only have basic coverage on it. Also known as PLPD in Michigan.

Seems to me if a SUV with the dark tinted windows blocks your vision by cutting you off you should be able to prove it in court. Nobody cares anymore. If you get screwed what is it to them? The officer was an ass. I would state what he did as well....changing the ticket because you questioned him...what a jerk!

From the other drivers insurance?? Yup. Each persons insurance is to cover their own vehicle. It don't matter who's fault it is. That's why they call it no fault. But you can collect up to $500 from the other driver insurance that was at fault. It's suppose to help cover the deductable. It's a damned poor system but that's what our wonderful folks in Lansing decided was best for the citizens. Especially Detroit.

That's freaking crazy!! So, if you don't carry comprehensive insurance, and you get slammed, you get screwed.
And I thought it was bad here that if you get in a accident, the cops show up, estimate the damage at less than a grand, and leave. No tickets, no points. Seriously, I had a Nissan Pickup, company truck, 5 months old, guy wiped out pretty much the whole front end. Cop showed up, said the damage to my truck was about 700.00, so no one was getting a ticket. Got the truck repaired, and the total repair costs were over 3 grand.

Yup that's pretty much it. I carry PLPD, (personal liability/property damage) on my vehicles so if I get hit in Michigan it's all my resposibility to pay for my damages except for the up to $500 from the driver that causes the wreck.
Since when are cops insurance adjusters and body damage experts?? That's nuts. Do you have any way of going back on the officer or department if the damage comes in considerably higher such as was the case with the Nissan??
