I thought you're supposed to yield to a person signaling into your lane if they're in front of you. Which is what sounds like happened.

An accident could have been avoided. It just takes one person to yield or avoid the person who has the blind spot.
My saying is: Becareful out there and watchout for the other guy!
I have had other drivers turn into me before and I had to get out of the way to avoid an accident. Just saying!

im a girl picture on my profile and all of you guys were proved wrong, they found the gentlemen at fault because he failed to maintain speed, as well as continue to accelerate when he should have pulled over my car is getting fixed sometime next week(:, thanks anyways guysThis is my festiva, there are many like it but this one is mine':fred:

yea they saw the points of impact as well as the size of my vehicle aviously they saw the fact my car was relativily small compared to his etc!, so yea glad things worked out aswell!This is my festiva, there are many like it but this one is mine':fred:

Right of way is determined if you were together in the same lane. Look at it as maintenance of way, like a railway train on the tracks. A streetcar or trolley can't change lanes. So, if it gets hit from the side, guess who's fault it is?
The person who hits another directly from behind is always at fault. No control of their vwhicle.

Yea at first I was put at fault just by the accident reports, at which point they sent an adjuster then by points of impact that it was then decided that the gentleman failed to stop when he should have aswell as over sped, for some reason they didn't declare my car a total loss because the car was running etc. so yup lolThis is my festiva, there are many like it but this one is mine':fred:

^Probably because you could show them $350 to repair damage. Otherwise, they would have sent out a report, realized they can't buy new fenders, ect. Then a total loss would have been declared.
