Um, I think they can, at least here in WV, but if it has a salvage title (which most yards around here get) they cannot legally be put back on the road. But I do know people who have gone to a j/y and bought whole cars as parts cars.

If the DMV/BMV has been notified that the vehicle destroyed/dismantled then they can not sell the whole car.
The title is listed as having been destroyed and a new one can not be obtained.
If in fact, a request is received for a new title there will be consequences to the JY, maybe even criminal charges.
If it was notified that it is a salvage title then they sell the whole car.
The JY pays to get a salvage title.
My guess is JY don't see enough business and profit in it to salvage title a Festiva.

You could always convince them to let you take it out part by part for one low price. Eg Doors, Hatch, Hood... then the rest of it LOL
